1. Agreement to These Terms
This website, https://mizzp.nyc, including its subdomains, interactive tools, and online hubs (the “Website”), and our online store are operated by Mizz P. Post-Secondary Success Consulting, LLC, d/b/a On Track With Mizz P. (“we,” “us,” or “our”).
By visiting the Website, using our tools, joining our email list, or buying from us, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, please do not use the Website or our products and services.
2. Who Can Use This Website
You must be 18 or older, or have permission from a parent or guardian, to use the Website and make purchases. The Website is not intended for children under 13. Parents and guardians are responsible for their minor children’s use of the Website.
3. Educational Information Only. No Guarantees.
Our content, products, tools, workshops, and consulting are for educational and informational purposes only.
- We do not guarantee college admission, scholarship awards, financial aid amounts, job offers, or any other outcome. Results depend on many factors outside our control.
- We are not attorneys, accountants, tax professionals, or financial or investment advisors. Nothing we provide is legal, tax, or financial advice.
- Financial aid rules, forms, deadlines, and award amounts change often. Always confirm details with official sources, such as StudentAid.gov, HESC, and each college’s financial aid office.
- You are responsible for your own decisions and for completing and submitting your own applications, forms, and deadlines.
4. Online Store
Our online store is hosted on Stan Store (“Stan”). Purchases made through our store are also subject to Stan’s terms of service and privacy policy. Payments are processed by Stan and its payment providers.
- All prices are in U.S. dollars and may change at any time without notice.
- We may refuse or cancel any order, including orders that appear fraudulent or are placed in error.
- You agree to give accurate and complete purchase information.
- If a product is listed with a pricing or description error, we may correct it or cancel the order and refund you.
5. Digital Products and Licenses
When you buy a digital product (such as a workbook, guide, checklist, game, or hub access), you get a limited, non-transferable license for personal use by you and your household. You may not:
- share, forward, resell, or give away the product, files, or access links;
- post the product on any website, shared drive, or social media; or
- copy, change, or present the product as your own.
Educators and counselors: an individual purchase covers use with your own students in one classroom or caseload. Use across a school, district, or organization requires a school or organization license.
School and organization licenses (such as the On Track Financial Aid Hub) are governed by the license agreement, proposal, or purchase order for that license, including its access period. Access ends when the license period ends unless it is renewed.
6. Refunds
Because digital products are delivered instantly, all sales are final and non-refundable. Please review product descriptions carefully before you buy.
If you were charged twice, did not receive your product, or have trouble accessing a file, email info@mizzp.nyc within [7] days of purchase and we will fix it, replace it, or correct the charge.
Refunds for school and organization services are governed by the written agreement for those services.
7. Physical Products and Third-Party Marketplaces
Some of our products, such as printed books and game decks, are sold and shipped through third-party platforms, including Amazon, The Game Crafter, and Teachers Pay Teachers. Purchases on those platforms follow that platform’s terms, shipping, and return policies. For physical items purchased directly from us, contact us info@mizzp.nyc – Subject: Customer Support within 14 days for returns or to report any issues with your order.
8. Interactive Tools, Online Hubs, and Artificial Intelligence (AI)
Interactive tools and hubs. Our interactive tools and hubs (such as checklists, budget tools, comparison tools, and resume or brag sheet builders) are provided for planning and educational purposes only.
- Results, estimates, and calculations are general and may not reflect your actual costs, aid, or outcomes.
- Do not enter sensitive information, such as Social Security numbers, FSA ID login details, or bank information, into any tool.
- We may update, change, or discontinue tools at any time.
AI-assisted content. Some of our content, products, and materials may be created with help from AI tools and are reviewed by a person before they are shared. AI can make mistakes. Like all our content, it is educational information only (see Section 3). Always confirm important details, deadlines, and dollar amounts with official sources.
AI features. Our Website, tools, and hubs do not use AI to generate responses or results for users. If we add an AI-powered feature in the future, it will be clearly labeled, its results will be general information only (not professional advice), and you should not enter sensitive information into it.
Using our content with AI. Without our written permission, you may not:
- upload, paste, or feed our paid products or content into AI tools, chatbots, or apps;
- use our content to train or improve AI models; or
- use AI to copy, rewrite, or repackage our content into new products or materials.
You may use translation tools, including AI translation, to translate our materials into your preferred language for your own or your family’s personal use.
9. Consulting, Workshops, and School or Organization Services
Workshops, staff trainings, school partnerships, and one-on-one consulting are provided under a separate written agreement, proposal, invoice, or purchase order. That agreement controls the scope, schedule, fees, cancellation, and payment terms. If it conflicts with these Terms, the written agreement controls.
10. Student Data From School Partnerships
When we work with schools, we may receive limited student information to deliver our services. We protect that information as described in Section 7 of our Privacy Policy and as required by FERPA, New York Education Law §2-d, NYCPS Chancellor’s Regulation A-820, and our agreements with each school. We never sell student data or use it for marketing. Our agreements with schools control how student data is handled.
11. Email List
By joining our email list, you agree to receive emails from us, including newsletters, free resources, and occasional offers. Consent is not required to buy anything from us. You can unsubscribe at any time using the link in any email or by emailing info@mizzp.nyc.
12. Giveaways, Raffles, and Contests
From time to time we run giveaways, raffles, and contests. Unless stated otherwise:
- no purchase is necessary to enter or win;
- specific rules, eligibility, dates, and prizes will be shared with each giveaway;
- winners under 18 may need a parent or guardian’s permission to accept a prize;
- we will only share a winner’s name or photo publicly with their permission (and a parent or guardian’s permission for minors); and
- giveaways are void where prohibited by law.
13. Intellectual Property
All content on the Website and in our products, including text, graphics, logos, images, videos, worksheets, games, tools, and the On Track Method™, belongs to us or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, distribute, sell, or create works based on our content without our written permission. This includes using our content to train AI models or using AI to create copies or competing products.
14. Comments, Feedback, and Testimonials
If you send us ideas, suggestions, or feedback, we may use them without owing you payment. We will only publish testimonials with your permission, and with a parent or guardian’s permission for anyone under 18. We do not create fake or AI-generated testimonials or reviews. If we use AI-generated images of people in our marketing, they do not show real students or clients and are not presented as real testimonials. To update or remove a testimonial, email info@mizzp.nyc.
You agree not to post or send anything unlawful, harassing, false, or harmful, or anything that violates someone else’s rights. We may remove any content at our discretion.
15. Prohibited Uses
You may not use the Website or our products to:
- break any law or encourage others to do so;
- harass, threaten, or discriminate against anyone;
- submit false or misleading information or pretend to be someone else;
- upload viruses or harmful code, or interfere with the Website’s security or operation;
- scrape, crawl, or collect other people’s personal information; or
- copy, resell, or misuse our content or products.
We may suspend or end your access if you violate these Terms.
16. Third-Party Links and Tools
The Website may link to or use third-party websites and tools, such as college, scholarship, and financial aid sites. We do not control them and are not responsible for their content, accuracy, or practices. Your use of them is at your own risk and subject to their terms.
17. Errors and Changes
We work to keep information accurate and current, but the Website may contain errors or outdated information, including historical information. We may correct errors, update content, change prices, or discontinue products or services at any time without notice. We are not responsible for any change, price change, suspension, or discontinuation of the Website or our services.
18. Disclaimer of Warranties
The Website, products, tools, and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of fitness for a particular purpose. We do not guarantee the Website will be uninterrupted, secure, or error-free.
19. Limitation of Liability
To the fullest extent allowed by law, Mizz P. Post-Secondary Success Consulting, LLC, its owner, and its contractors will not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, missed deadlines, or denied admissions or aid, arising from your use of the Website, products, or services. Our total liability for any claim will not exceed the amount you paid us for the product or service involved in the 12 months before the claim. Some states do not allow certain limits, so some of these limits may not apply to you.
20. Indemnification
You agree to protect and hold harmless Mizz P. Post-Secondary Success Consulting, LLC, its owner, and its contractors from any claims, costs, or damages (including reasonable attorney’s fees) arising from your violation of these Terms, your misuse of our content or products, or your violation of any law or anyone else’s rights.
21. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. If you have a concern, please contact us first at info@mizzp.nyc so we can try to resolve it informally within 30 days. Any legal action must be brought in the state or federal courts located in the City of New York, and you agree to their jurisdiction.
22. Termination
We may end or suspend your access to the Website or products at any time if you violate these Terms. Sections that by their nature should continue, such as Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification, will survive.
23. Severability, Entire Agreement, and Changes
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a right does not waive it. These Terms, our Privacy Policy, and any written agreement for specific services are the entire agreement between you and us and replace all earlier versions.
We may update these Terms at any time by posting the new version on this page with a new “Last Updated” date. Continuing to use the Website after changes means you accept them.
