We take your privacy very seriously. In this privacy policy (“Privacy Policy”), we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our Websites and our services.

This privacy policy applies to all information collected through our Websites (such as https://mizzp.nyc & https://on-track-for-college.myshopify.com/), mobile application “On Track for College,” and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the “Services”).

Please read this Privacy Policy carefully as it will help you make informed decisions about sharing your personal information with us.

NOTE* Your use of this site constitutes your acceptance of this Privacy Policy and consent to the practices described herein. We may update or revise this Privacy Policy at any time. You agree to review this Privacy Policy periodically. We will use your Personal Information in a manner consistent with the Privacy Policy in effect at the time you submitted the information.

You may visit and browse the Websites without providing personally identifiable information about yourself. However, this may limit your ability to receive certain features, products or services from us.

INFORMATION COLLECTED

Information You Provide

If you register at the Websites, enter a promotion, opt-in to receive emails or other offers or communications, we may collect information that can be used to identify you as an individual such as your name, email, telephone number, or home address (collectively, “Personal Information”). We may also ask you to provide other information, such as demographic information (e.g., gender, age) or information about your product preferences & interests especially if working one on one with us.

Additionally, when you make a purchase or attempt to make a purchase through the Website, we only collect certain Personal Information for purposes of verify your order, including your name and telephone number.  However, we do not collect your credit card or other payment information, which may be collected by Shopify and is not subject to this Privacy Policy (see section “Payment Provider” below). 

Website Usage Information

On Track With Mizz P. and its third-party service providers may use a variety of technologies that passively or automatically collect information about how the Websites are accessed and used (“Usage Information”), including your browser type, IP address, device type, operating system, application version, the pages served to you, the time you browse, preceding page views, and your use of features or applications on the Websites. This statistical data helps us understand what is interesting and relevant to users of the site so we can best tailor our content.

Cookies

Like many websites, we may use data files placed on a computer, mobile device, technology or other device (collectively, “Device”) when it is used to visit the Websites to facilitate site navigation and to personalize your experience, including tailoring advertisements or offers likely to appeal to you, based on your interests, preferences, location, or demographic information. If you would prefer not to accept cookies, you can change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; or set your browser to automatically not accept any cookies. However, please be aware that by doing so, some features and services on our Websites may not work properly.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

We may also use local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.

We may also use log files which track actions occurring on the Website, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

USE AND SHARING OF INFORMATION

We use the information collected from you for purposes based on our reasonable business interests, the fulfillment of our contract with you, and compliance with our legal obligations, including without limitation:

  1. responding to your questions and requests;
  2. providing you with access to certain areas and features of the Websites;
  3. verifying your identity;
  4. fulfilling product purchases;
  5. communicating with you about your account and activities on the Websites;

Except as provided in this Privacy Policy, we will not provide any of your Personal Information to any third parties without your specific consent. We do not disclose credit card or other personally identifiable financial information other than as necessary to complete a credit card or other financial transaction, or upon explicit permission from the applicable user. 

We may share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

Third Parties Providing Services On Our Behalf: We may share your Personal Information with third parties, including Shopify and Google Analytics, that perform functions on our behalf (or on behalf of our partners) such as service providers that host or operate our Websites, analyze data, process transactions and payments, fulfill orders or provide customer service; advertisers; sponsors or other third parties that participate in or administer our promotions, contests, sweepstakes, surveys or provide marketing or promotional assistance.

Business Transfers: We may share your Personal Information with other entities and our affiliates in the family of companies controlled by us for internal reasons, primarily for business and operational purposes. As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or our assets, or assets related to the Websites, Personal Information, Usage Information, and any other information that we have collected about the users of the Websites may be disclosed to such entity as one of the transferred assets.

Legal Disclosure: We may transfer and disclose information, including your Personal Information, Usage Information and IP address, to third parties to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our User Agreement or other applicable policies; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to our Websites, or the public.

YOUR PRIVACY RIGHTS, CHOICE AND ACCESS

Subject to the Legal Disclosure provisions above, you may direct us not to share your Personal Information with third parties, not to use your Personal Information to provide you with information or offers, or not to send you newsletters, e-mails or other communications by following the removal instructions in the communication that you receive or by emailing us at Info@mizzp.nyc.

In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Websites. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons. 

Online tracking opt-out. We may use cookies or add-ons on the Website for marketing purposes.  There are a number of ways to opt out of having your online activity and device data collected through our Services, which we have summarized below:

  • Blocking cookies in your browser. As explained above, most browsers let you remove or reject cookies, including cookies used for interest-based advertising. Payment Provider

Payments on our Services are handled by Shopify, which provides us with the online e-commerce platform that allows you to purchase products and services. The information you provide to Shopify in connection with your payment and purchases is handled in accordance with Shopify’s Terms of Service and Privacy Policy. CHILDREN

The Websites are not directed to children under 13. We do not knowingly collect, use or disclose personally identifiable information from anyone under 13 years of age. If we become aware that we have unknowingly collected personally identifiable information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.

SECURITY OF YOUR INFORMATION

We maintain reasonable safeguards to protect Personal Information against loss, unauthorized use, disclosure or destruction and when transferring information for processing. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information to you transmit to us. We restrict authorized access to your Personal Information to those persons who have a legitimate purpose to know that information to provide products or services to you and those persons you have authorized to have access to such information.

How Long We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What Rights You Have Over Your Data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

International Users

We maintain information in the United States and in accordance with the laws of the United States, which may not provide the same level of protection as the laws in your jurisdiction.
